Depending on how you plan to leave, the accrued vacation pay can sometimes be more or sometimes less. Nusrat Khalilov, an expert on labor legislation, explains how taking leave in different situations affects the increase or decrease of leave pay.

When you plan your vacation, you need to know which dates are more convenient for you. This can be considered advantageous in two ways. First, some people find it beneficial to have more vacation pay, and some people to have more vacation days.

First of all, let's note that the Labor Code does not specify any norm limiting the start or end of leave to fall on non-working days. In this regard, based on the employee's application, the first and last day of leave may be a non-working day. Starting the leave from a non-working day, although it is not considered logical because the weekend days are the employee's rest days anyway, it can be applied because the legislation does not prohibit it. If the last day of leave falls on a non-working day, the employee's starting date will be the first working day after the non-working day. Since leave days are given on calendar days, there is no restriction on when the start and end dates fall. Based on the mentioned, let's look at different nuances.

- To use less vacation days

If we want to have a lot of rest using less vacation days, then we should take the vacation from the first day of the week to the end of the week. At this time, although weekends are not included in the vacation day, you will have the chance to rest for 9 days in the 5-day vacation period. At the same time, let's note one issue that according to Article 114 of the Labor Code, holidays that are not considered working days that coincide with the period of labor leave are not included in the calendar days of leave and are not paid. Therefore, if you want to rest more with fewer vacation days, you can reduce your vacation to months with more holidays, namely January and March. In this case, the vacation period will be extended to the vacation days that coincide with the holidays.

- To have more leave fees

When taking a leave, it is necessary to reduce the leave to rest days in order to have more leave pay. That is, it is necessary to take the leave starting from the last day of the week or the rest day and plan the end time of the leave to fall at the beginning of the week. It is necessary to try to include the weekends in accordance with the vacation days. In this case, since vacation days are calculated based on calendar days, payment will be calculated based on rest days. But in this case, you will use more vacation days.

- Paying attention to fewer holidays and more working days

One of the most important points during the leave is to pay attention to fewer holidays and more working days in the month of leave. The employee's salary is the same for the months, but it is different for the working days in the months. Due to the fact that there are more and less working days in some months, the salary per working day may be more or less, respectively.

Example 1: An employee receives a fixed monthly salary of 1,500 manats. For comparison, let's pay attention to the amount of wages per working days during vacation in March and August.
According to the production calendar of 2021, there are 17 working days in March and 22 in August. If the salary of 1,500 manats is 88.24 manats per working day in March, this figure is 68.18 manats in August:

1,500 : 17 = 88.24 manats;

1,500 : 22 = 68.18 manats.

Even if the employee does not go on vacation and works, the salary per working day changes, but the final salary remains the same as a result. If we consider that the average monthly salary of an employee is 1,500 manats, the average vacation pay per day will be 49.34 manats:

1500 : 30.4 = 49.34 manats.
